Terms of Service
Before you use the service, read these terms.
This page sets out your rights and obligations when using DownloadPatent, including the service itself, your account, payment, liability, and governing law.
These terms form the agreement between you and DownloadPatent governing your use of the service. By creating an account or using the service, you agree to be bound by them.
1. Acceptance of terms
Please read these terms carefully before using DownloadPatent (the "Service"). You must be at least 18 years old, or have full legal capacity under the laws that apply to you. If you are using the Service on behalf of an organization, such as a law firm or company, you represent that you are authorized to bind that organization to these terms. If you do not agree, do not register for or use the Service.
2. Description of the service
DownloadPatent prepares patent-related documents based on the identifiers you supply (such as patent numbers) and Office Action ("OA") citations, where those are supported by the Service. Output may include PDFs of cited patents where obtainable, batch packages, and lists of non-patent literature (NPL) citations. The Service does not download the full text of NPL references, and does not generate or file an Information Disclosure Statement (IDS) on your behalf; preparing and filing an IDS remains your responsibility. Citations are extracted using optical character recognition (OCR) and, in some modes, large language models operated by third-party providers. Output produced this way may be incomplete or wrong.
3. Independent service
DownloadPatent is an independent service. It is not affiliated with, endorsed by, or sponsored by the USPTO, EPO, JPO, WIPO, CNIPA, KIPO, TIPO or any other patent office. Office names, numbers and marks appear only to identify the documents and sources the Service works with, and belong to their respective owners.
4. Your account and account security
You must register with accurate and complete information, and you are responsible for keeping your account credentials confidential, including your password (a minimum of 8 characters), and for all activity under your account. If you believe your account has been accessed without authorization, contact us immediately through our contact page. For security, login sessions expire after 7 days and require you to sign in again.
5. Acceptable use
You may only submit documents and data that you are authorized to handle. You may not: scrape or automate bulk extraction of content from the Service, or circumvent its usage limits; resell, rent, sublicense, or otherwise provide account access to unauthorized third parties; abuse the Service to evade normal rate or usage limits; or otherwise use the Service in violation of these terms or applicable law. Violating this section may result in suspension or termination of your account (see Section 13).
Using the DownloadPatent API with your own API key, within its published limits and under Section 20, is authorized and is not automated extraction for the purposes of this section.
6. Sanctions and export controls
By using the Service you represent that you are not located in, ordinarily resident in, or acting for anyone in a country or region subject to comprehensive sanctions or an embargo under laws that apply to us or our service providers (such as those of the United States, the European Union, the United Nations or Taiwan), and that you are not named on any government sanctions or restricted-party list. You may not use the Service to export, re-export or transfer documents in breach of applicable export-control or sanctions laws. We may use the country associated with your IP address and your billing country to check this section, and we may refuse, restrict or end access, or decline a payment, where we reasonably believe it is not met or where the law or a payment or infrastructure provider requires it.
7. Source availability, no guarantee of results
Documents and metadata returned by the Service depend on whether the corresponding content is available, at the time of your request, from the public sources it supports (such as national patent offices and public databases). A valid identifier or citation does not guarantee that a document will be obtainable — it may be unavailable because the publication has not been published in a retrievable form, its format is unsupported, or the source itself imposes limits. Documents that cannot be obtained are flagged for your review; the remaining available files can still be selected and downloaded as usual.
8. Your review obligations
Output from the Service is assembled automatically from the identifiers and citations you provide. Before relying on any output for a patent filing, response, or other legal proceeding, you must independently verify that citations are correct, that identifiers correspond to the publication you intend, and that the documents obtained are complete and accurate. We are not responsible for how you use the output or its adequacy for any official proceeding. Output is produced with automated processing, including OCR and artificial intelligence (AI), and can contain errors or omissions. Treat it as a working aid, not as a verified result.
9. Plans, pricing, and payment
The Service uses an account balance of credits, priced in US dollars. While signed in, downloading a patent PDF is free up to 200 a day per account, or 200 a day on Monthly; past that, each patent is US$0.005. An Office Action is US$0.15 for a citation list or US$0.25 for full text, and each other-language version that is found and delivered is US$0.03; these are charged per use from your credits. A successful job is charged even if you do not download its results; anything that fails is not charged. Monthly is US$20 per month and includes 100 office actions in each subscription period, together with other-language versions; past 100, the per-use prices apply. After you verify your email we add US$3 in sign-up credits to your account. We may also give promotional credits, for example to thank you for taking part in an interview; their expiry date is the one we tell you when we give them, and it is shown on your account's Balance page. All free credits, including sign-up and promotional credits, expire on their expiry date (sign-up credits 30 days after they are granted), cannot be refunded, and cannot be exchanged for cash; this does not limit any right you have under applicable consumer protection law. When a charge is made, the credits that expire first are used first. Credits can be added in fixed packs of US$10, US$25 or US$50, with payment fees included in the pack price. Prices and plan details are subject to change; any change is published on our pricing page, and a change to your disadvantage is announced by email at least 14 days before it applies. If we make a material change to these terms, we ask you to accept it when you sign in; until you do, you cannot start new work from the date it applies, but you can still download existing results, view your balance and request a refund. Payments are processed by third-party payment service providers; we do not store your full card number in our database. Balance added to your account by purchase has no expiry date.
From 2026-11-18, a free account gets 100 free patent PDFs a month. Monthly includes 3,000 patent PDFs a month, counting other-language versions, and 50 office actions. Past that, each patent is US$0.01. The website and the API share one allowance. Credits you have already bought keep their value.
10. Subscriptions, cancellation and withdrawal
Monthly is a subscription of US$20 per month that renews automatically each month until you cancel. Each month, the monthly price is charged to the payment method you used to subscribe. You can cancel at any time on the Balance page. Cancellation takes effect at the end of the period you have paid for; you keep access until then and are not charged again. We do not refund a period that has already started, except for the cases listed in the refund policy (such as a duplicate or erroneous charge) and where the law gives you a right to a refund. If you are a consumer in the European Union or the United Kingdom, you may have a statutory right to withdraw from a distance contract within 14 days. Where the law allows, that right is affected if you ask us to begin the service during that period, and if you withdraw after the service has begun you may be asked to pay a proportionate amount for what was provided. The same applies to credit packs: if you ask us to make purchased credits available immediately, credits you have already used count as service provided, and once all the credits from a pack have been used, the right of withdrawal for that pack ends. Contact us through the contact page to exercise it. Monthly is for one person: one Monthly account may not be shared by several people. If we find that an account is shared, we may ask you to use separate accounts or suspend the plan. Nothing in this section limits any right you have under mandatory law.
11. Refunds
Individual consumers using the Service for non-business purposes may, under Article 19 of Taiwan's Consumer Protection Act, withdraw from the purchase or the service contract without giving a reason within 7 days of the day following delivery. Free credits, including sign-up and promotional credits, are not refundable, and subscription fees are covered by the section on subscriptions. Nothing in this section limits any right you have under mandatory law.
12. Service availability
We work to keep the Service running reliably, but we do not commit to any specific service-level agreement (SLA), recovery time objective (RTO), or recovery point objective (RPO). The Service depends on multiple upstream public data sources (such as national patent office databases) and third-party model providers; interruptions, changes, or discontinuation of those sources are outside our control and do not constitute a guarantee or commitment by us regarding the Service's availability.
13. Intellectual property
You retain whatever rights you already hold in the documents and data you upload to the Service, and in the output you obtain through it; we do not acquire any rights in them by virtue of your use of the Service. The Service's software, interface, design, and the DownloadPatent marks belong to us or our licensors, and may not be reproduced, modified, or otherwise used without our consent.
14. Sources and copyright
Documents are retrieved from public official and third-party databases. They may contain content in which third parties hold rights, such as drawings with copyright notices, and some sources apply their own terms of use. DownloadPatent does not alter the source documents and does not claim rights in them. You are responsible for using them lawfully. If you believe content available through the Service infringes your rights, tell us through the contact page, giving the document identifier, the rights you claim and your contact details, and we will review it promptly.
15. Limitation of liability and disclaimer
The Service is provided "as is," without warranty that it will be uninterrupted, error-free, or fit for your particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service; our aggregate liability to you is capped at the amount you actually paid us in the twelve months preceding the event giving rise to the claim. Nothing in these terms limits the statutory rights you hold as a consumer under the Consumer Protection Act or other applicable law.
16. Force majeure
We are not liable for delay or failure to perform caused by events reasonably beyond our control, including natural disasters, government action, network or power outages, or interruptions or changes affecting upstream patent data sources or third-party model providers.
17. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account access if you breach these terms, and will give notice in advance where reasonably possible. After termination, your data is handled as described in our document privacy policy. Uploaded and generated documents have a temporary access window of up to 24 hours, after which access is disabled and scheduled cleanup removes the files; failed-job files are cleared. Account closure does not grant continued access. Retention of account and usage records is described in our privacy policy.
18. Governing law and jurisdiction
These terms are governed by the laws of the Republic of China (Taiwan). Any dispute arising out of or relating to these terms is subject to the exclusive first-instance jurisdiction of the Taipei District Court, Taiwan, without limiting any other jurisdiction a consumer may invoke under the Consumer Protection Act. Nothing in this section removes the mandatory consumer-protection rights you have under the law of the country where you live.
19. Changes to these terms
We may modify these terms from time to time. For material changes, we will give reasonable advance notice before they take effect, such as an in-product notice or email. Continuing to use the Service after a change takes effect means you accept the revised terms.
20. API use
You may use the DownloadPatent API with API keys you create in your account settings. You are responsible for keeping your keys secret and for all use of, and charges made with, your keys; revoke a key in your settings as soon as you suspect it has been exposed. API calls are subject to the rate limits, free allowances and prices published in the API reference, spend the same credits as the website, and are otherwise governed by these terms. You may use API results in your own work and for your clients, but you may not resell, sublicense or share your API access or keys, or offer the API or its results as a bulk or competing service. We may revoke keys, limit or suspend API access to protect the Service, other users or the sources we rely on, or when these terms are breached. We keep /v1 backward compatible and announce incompatible changes in a new version before retiring an old one, but the API is provided under the same availability terms as the rest of the Service (see Section 12).
For the full conditions and process for requesting a refund, see our Refund policy.
For a full explanation of how data is handled and retained, see our Privacy policy.
